DL Update

As we enter the second half of the year, our organization is committed to upholding its status as the leading trade organization for commercial real estate development.

Legislative Update
In May, NAIOP Charlotte teamed up with the Piedmont Triad and Raleigh-Durham chapters for our annual State Capitol Day. More than a dozen members from the Charlotte chapter (including several DL’s) made the trip to Raleigh to speak to key members of the general assembly. Highlights included meetings with Rep. Tim Moore (House Speaker), Sen. Phil Berger (Senate President), Rep. John Bell (House Majority Whip), Sen. Jerry Tillman (Senate Majority Whip) and Rep. Charles Jeter (House Republican Caucus Chair).

The conversations centered around the implications of HB2 and its ensuing media storm on our industry. NAIOP committee members cited examples of business that has already been lost due to HB2’s impact on corporate relocation decisions. The purpose of the conversations was not only to emphasize the impact that the legislation is having on real estate development, but also to avail our group as a bridge between state and local leaders to reach a compromise. As of today, a resolution has yet to be realized.

In addition to the discussion on HB2, NAIOP committee members thanked legislators for their support of repealing North Carolina’s Protest Petition statute in 2015. The statute allowed as few as five percent of neighbors within 100 feet of a proposed development to file a petition that would force a rezoning applicant (developer) to secure a supermajority of affirmative votes from the city council for rezoning approval. In Charlotte, this meant that a petitioner had to secure 9 of 11 city council votes for a rezoning to be approved in instances requiring a supermajority. The repeal was lobbied for by NAIOP, REBIC, CRCBR and several other real estate organizations. The repeal came into effect on August 1st.

The legislative committee will meet later this summer and strategize on the advancement of NAIOP’s legislative priorities. Stay tuned for an update in the fall on those efforts.
